SCOPE: We are seeking an experienced Subrogation & Property Damage Attorney to join our team. The ideal candidate will have a strong background in personal injury law, specifically related to automobile accidents. This role involves representing the company in legal matters, managing claims, and providing expert legal advice to ensure compliance with all applicable laws and regulations. Additionally, you will work closely with the claims department to ensure legal compliance, mitigate risk, and negotiate settlements. Your role will involve staying current on Texas insurance laws, advising internal teams, and actively participating in mediation, arbitration, and settlement discussions to protect the company’s interests. This position is open to applicants located in the Texas market and offers the flexibility of working remotely. DUTIES: <div style="text-align:justify;"><h3>Property Damage:</h3><ul><li>Represent insurers or clients in claims involving damage to real or personal property (e.g., vehicle damage, fire, water, hail, vandalism).</li><li>Investigate cause of damage, assess liability, and evaluate repair estimates or total loss value.</li><li>Review and analyze property appraisals, engineering reports, and repair invoices.</li><li>Negotiate settlements with opposing counsel, third parties, or claimants.</li></ul><h3>Subrogation:</h3><ul><li>Pursue recovery from at-fault third parties after a claim has been paid by the insurer.</li><li>File lawsuits or arbitration claims against liable parties (e.g., other drivers, contractors).</li><li>Collaborate with adjusters to review subrogation potential and gather evidence.</li><li>Manage pre-litigation demand letters and post-litigation recovery efforts.</li></ul>Additional Duties:</div><ul><li style="text-align:justify;">Represent the company in all phases of litigation, from pre-suit investigations to trial and post-trial activities.</li><li style="text-align:justify;">Develop case strategies, draft pleadings, motions, discovery, and attend depositions, mediations, hearings, and trials.</li><li style="text-align:justify;">Provide expert legal advice to the claims department, management, and other internal teams regarding property damage claims.</li><li style="text-align:justify;">Ensure that all actions taken during the claims process comply with applicable laws and regulations.</li><li style="text-align:justify;">Advise on legal risk related to policy interpretations, claims settlements, and potential exposure.</li><li style="text-align:justify;">Negotiate settlements on behalf of the company in a timely and cost-effective manner.</li><li style="text-align:justify;">Participate in mediations, arbitrations, and settlement conferences with a focus on favorable outcomes for the company.</li><li style="text-align:justify;">Conduct thorough legal research on property damage, insurance laws, and regulations in Texas, including recent court decisions and statutory developments.</li><li style="text-align:justify;">Prepare clear, concise, and persuasive legal documents such as briefs, memoranda, and opinions.</li><li style="text-align:justify;">Stay current with changes in insurance and property damage laws in Texas, ensuring the company is compliant with local, state, and federal laws.</li><li style="text-align:justify;">Assist in developing policies and procedures to minimize legal exposure and maximize operational efficiency.</li><li style="text-align:justify;">Collaborate with the claims department, adjusters, and other legal teams to provide proactive and responsive legal support.</li><li style="text-align:justify;">Communicate complex legal concepts and strategies to non-legal personnel clearly and effectively.</li></ul>Qualifications:<ul><li>Juris Doctor (JD) from an accredited law school.</li><li>Admission to the Texas Bar and good standing.</li><li>Bilingual in English and Spanish is highly desirable.</li><li>Strong understanding of insurance laws and regulations.</li><li>Ability to analyze complex legal issues and develop effective strategies.</li><li>Proficient in legal research tools and case management software.</li></ul>SKILLS & EXPERIENCE:<ul><li>Minimum of 3-5 years of years of experience in personal injury law, with a focus on automobile accidents.</li><li>Strong litigation experience with trial skills preferred.</li><li>Excellent negotiation, oral advocacy, and legal writing skills.</li><li>Ability to handle a high volume of cases and prioritize effectively.</li><li>Proficiency in case management software, legal research tools, and Microsoft Office.</li></ul> BENEFITS:<ul><li>401(k) Retirement Savings Plan with employer match.</li><li>Comprehensive Medical, Prescription Drug, Vision, and Dental Insurance</li><li>Paid Time Off, Holidays, and Leave programs.</li><li>Flexible spending accounts</li><li>Basic Life Insurance and Voluntary Life/ADD</li><li>Short Term and Long-Term Disability</li></ul> UAIC participates in the E-Verify program to confirm the employment eligibility of all newly hired employees.
